Welcome to Yagentz! These Terms and Conditions ("Terms") govern your access to and use of the Yagentz website, mobile application, and all associated services (collectively, the "Services"). Please read these Terms carefully, as they constitute a legally binding agreement between you ("User," "you," or "your") and Yagentz ("we," "our," or "us").
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any of these Terms, please do not use our Services.
1. About Yagentz
Yagentz is an online real estate platform designed to connect buyers, sellers, renters, investors, and agents. The platform allows users to:
- List residential or commercial properties for sale or rent;
- Browse available listings;
- Save favorite listings;
- Communicate directly with property owners, sellers, or listing agents.
Yagentz serves solely as a neutral venue for user interactions and does not act as a real estate broker, agent, or fiduciary for any user.
2. User Accounts
To fully access and utilize Yagentz features (e.g., creating listings, saving properties, or messaging other users), you must register for an account.
By creating an account, you agree to:
- Provide accurate, current, and complete information during registration;
- Keep your login credentials confidential and secure;
- Be solely responsible for all activity under your account;
- Immediately notify us of any unauthorized use or suspected breach of your account.
We reserve the right to refuse, suspend, or terminate any account at our discretion.
3. User Responsibilities
By using Yagentz, you agree to the following:
- Use the Services only for lawful purposes related to real estate transactions;
- Comply with all applicable local, state, and federal laws and regulations;
- Not post, upload, or transmit any content that is false, misleading, illegal, discriminatory, defamatory, obscene, offensive, or violates the rights of others;
- Not impersonate any person or entity or misrepresent your affiliation;
- Not engage in data mining, scraping, or any use of automated systems;
- Respect the privacy, rights, and experience of other users;
- Update your listings promptly if the property is sold, rented, or no longer available.
Failure to adhere to these responsibilities may result in suspension or permanent termination of your access to the platform.
4. Listings and User-Generated Content
Users are solely responsible for the accuracy and legality of any content or property listings they submit to the platform. This includes but is not limited to:
- Listing details (price, location, features);
- Images, videos, and descriptions;
- Availability status of the property.
Yagentz does not verify, guarantee, or endorse the quality, condition, legality, or availability of any property listed.
We reserve the right to:
- Edit, modify, or remove any content that violates our Terms or is deemed inappropriate;
- Deny any refund in cases where a user fails to update the property's status (e.g., sold, leased, or inactive).
5. Paid Services
Yagentz may offer premium services, featured listings, or advertising opportunities for a fee. When such services are used:
- All pricing and service details will be transparently disclosed before any payment;
- Fees are non-refundable unless explicitly stated otherwise;
- All transactions are final and binding.
Yagentz is not liable for the outcome or effectiveness of any paid service.
6. Intellectual Property
All content on the Yagentz platform—including text, graphics, logos, icons, images, software, and interface design—is either owned by or licensed to Yagentz and is protected under U.S. and international intellectual property laws.
Except where explicitly authorized:
- You may not reproduce, republish, upload, transmit, distribute, or create derivative works from any Yagentz content;
- You may not use any trademark, logo, or brand elements without our written permission.
7. No Advice and No Transaction Liability
Yagentz is not a party to any property transaction between users. We do not offer legal, financial, mortgage, or real estate advice. All information on the platform is for informational purposes only.
- Users are responsible for verifying the accuracy of listings and conducting their own due diligence before entering into any transaction;
- Yagentz is not responsible for any disputes, damages, or losses resulting from your interaction or transaction with other users;
- Any communication or negotiation between users is at their own risk;
- We make no guarantees about the success or legality of any transaction conducted through our platform.
8. Third-Party Services and ID Disclaimer
In some cases, Yagentz may integrate or refer you to third-party services, including for:
- Identity verification;
- Credit/background checks;
- Financing or mortgage applications.
By using such features, you acknowledge:
- Yagentz merely facilitates connections and is not responsible for the actions, policies, or outcomes of any third-party service provider;
- You release Yagentz from liability for any misuse, data breach, unauthorized use, or damage caused by third-party vendors.
Always review third-party terms and privacy policies before using their services.
9. Limitation of Liability
To the fullest extent permitted by law, Yagentz and its affiliates shall not be liable for any:
- Indirect, incidental, punitive, or consequential damages;
- Loss of profits, data, goodwill, or property;
- Unauthorized access to your account or content.
Our total liability to you, for any and all claims, is limited to the total amount you paid (if any) to Yagentz within the past 12 months.
10. Termination of Service
Yagentz may suspend or terminate your access to the Services, at our sole discretion, at any time and without notice, especially if you:
- Violate these Terms;
- Misuse the platform;
- Engage in fraudulent or harmful behavior.
Upon termination, your right to use the Services will immediately cease, and any outstanding obligations (including unpaid fees) shall remain in effect.
11. Modifications to Terms
We reserve the right to modify, amend, or update these Terms at any time. When changes are made:
- A notice will be posted on our website or emailed to registered users;
- Continued use of Yagentz after changes go into effect constitutes your acceptance of the new Terms.
You are responsible for reviewing the Terms periodically for updates.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
- Any disputes or legal proceedings arising out of these Terms shall be brought in the appropriate courts located in Georgia;
- You consent to the jurisdiction and venue of such courts.
